OUR SERVICES

Our office will only collect your personal data for the following purposes:

  • To carry out assignments for advice or other services;
  • To comply with legal tasks and obligations; or
  • For the purposes for which you have specifically given your consent.

Your data will not be processed for other purposes without your consent. Personal data is requested for the drawing up of a notarial deed or the performance of another assignment.

RULES ON PERSONAL DATA IN RELATION TO NOTARIAL DEEDS

If KB Notarissen B.V. prepares a notarial deed that includes your personal data the notary must comply with statutory regulations. These affect the processing of personal data:

  1. The civil-law notary is obliged to include certain (personal) data in the deed. Your data are therefore processed on a legal basis.
  2. The notary has to keep the signed deed with your personal data forever.
  3. Once the deed has been signed by the notary, it becomes an official piece of evidence. Nothing more can be changed, even if the personal details are incorrect. If any changes are necessary, the notary must draw up a new deed that includes the changes.
  4. The notary is required to check certain (personal) data in the Basic Registration of Persons (BRP), Trade Register and Land Register.
  5. The notary is obliged to check your identity. For this purpose, he must request a valid identity document from you. The notary is one of the few people who are allowed to copy this document with all the data it contains.
  6. Your personal details fall under the professional secrecy of the notary. Unauthorised persons cannot gain access to the data.

    • Acquisition of new clients
    • Cross-selling to existing clients
  • The processing of personal data by ‘Processing contact requests via the website has the following purposes and corresponding legal bases:
    • Acquisition of new customers
    • Cross-selling to existing customers
  • The processing of personal data ‘Submitting registrations via the website for regular ‘Updates’ has the following purposes and corresponding legal bases:
    • Acquisition of new customers
    • Cross-selling to existing customers
  • The processing of personal data left via the website has the following purposes and corresponding legal grounds:
    • Offering tangible information/recommendations regarding the services of KB Notarissen B.V.

SOURCE OF PROCESSED PERSONAL DATA

If KB Notarissen B.V. processes personal data which has not been directly obtained from you, then this will always be done in the context of the assignment given to us. The source of these data will then be one of the following:

  • Public registers, including the Land Registry
  • An estate agent or another advisor in connection with a purchase agreement in which you are one of the parties
  • Donor

PASSING ON YOUR PERSONAL DETAILS

KB Notarissen B.V. will only pass on your personal data to others (third parties) if this is legally required or if this is necessary for the performance of the activities.

KB Notarissen B.V. provides personal data to the following recipients:

  • KB Notarissen B.V. employees only.
  • All visitors of the website (in case of reference/reviews)

KB Notarissen B.V. does not pass on personal data outside the EU or to any international organisation.

STORAGE OF YOUR PERSONAL DATA

Your personal data will be kept by KB Notarissen B.V. no longer than is necessary for the purpose for which it was collected, for the performance of statutory tasks and the fulfilment of legal obligations or the performance of agreements (e.g. limitation periods). Retention periods from legal provisions such as the Notary Act and the Archives Act apply. Notarial deeds are kept forever.

YOUR RIGHTS REGARDING THE PERSONAL DATA PROCESSED BY US

Should your data be processed by our firm, you can exercise the rights set out below based on the General Data Protection Regulation.

You can do so by making a request (preferably in writing) using the contact details provided in this privacy statement. Before we grant your request, we will first identify you in person employing a valid identity document.

Data subject’s right of inspection
You can always request which personal data KB Notarissen B.V. processes, for which purpose and for how long these are kept. There may be a legal basis why we cannot comply with your request, we will assess this and inform you accordingly.

Right to rectification
If you are of the opinion that certain data have not been processed correctly, you have the right to request rectification of these data. If this concerns data contained in a notarial deed,

This will not be possible, and the new deed will be drawn up and considered an additional to the faulty deed.

Right to data erasure (right to “forget”)
If you want your personal data to be deleted, you can submit a request to that effect. If the data is contained in a notarial deed, the notary is not permitted to delete it.

Right to restriction of processing
If you would like to restrict the processing of personal data by KB Notarissen B.V. (in anticipation of a requested rectification of your personal data, an objection made against the processing or because you do not want the data to be removed despite the processing being unlawful) you may submit a request to this end.

Right to data portability
If your personal data is not processed for a notarial deed and you wish to transfer the personal data to another service provider, you can submit a request to that end. Such a transfer is not always possible, however, as legal notarial duties may oppose it.

Possible restrictions in exercising your rights under the General Data Protection Regulation

DATA PROTECTION

KB Notarissen B.V. makes every effort to comply with your rights under the General Data Protection Regulation. However, it may happen that these rights are in conflict with other legal provisions such as the Notaries Act. Should KB Notarissen B.V. or one of the civil-law notaries associated with this office be unable to comply with your request for this reason, you will be notified accordingly in writing.
